The Environmental Protection Agency (EPA) regulates environmental impact — and operating without the required permits can result in significant fines, closure orders, and criminal prosecution.
The Legal Framework
Environmental permits are required under:
- The Environmental Protection Agency Act, 1994 (Act 490)
- The Environmental Assessment Regulations, 1999 (L.I. 1652)
These laws require businesses that may have significant environmental impact to conduct an Environmental Impact Assessment (EIA) and obtain EPA approval before commencing operations.
Which Businesses Need EPA Registration?
Schedule I: Mandatory EIA (Full Assessment)
Large-scale or high-impact businesses that require a full Environmental Impact Assessment:
- Mining and quarrying operations
- Oil and gas exploration and production
- Large-scale manufacturing (chemicals, cement, steel, paper)
- Timber processing and sawmills
- Large-scale agriculture (1,000+ hectares)
- Dams and water infrastructure projects
- Major road and infrastructure projects
- Airports and ports
- Power generation plants
- Petroleum product storage
Schedule II: Registration Certificate Required
Medium-impact businesses require an EPA Registration Certificate (simpler than a full EIA):
- Hotels and resorts
- Hospitals and large clinics
- Waste management companies
- Funeral homes and mortuaries
- Vehicle repair workshops (above a certain size)
- Dry cleaning businesses
- Printing and dyeing operations
- Food processing operations
- Veterinary establishments
- Some chemical retailers
The EIA Process (Schedule I)
- Preliminary Environmental Assessment (Screening)
- Terms of Reference prepared and submitted to EPA
- Environmental Impact Statement (EIS) prepared by accredited environmental consultant
- Public consultation and review period
- EPA review and decision
- Environmental Permit issued (if approved)
Timeline: 6–24 months. Cost: GHS 20,000–500,000+ (depends on scale and consultant fees)
EPA Registration Certificate (Schedule II)
Simpler process:
- Submit application to EPA with business details
- EPA inspects the facility
- Applicant implements any required mitigation measures
- EPA issues Registration Certificate
Timeline: 1–3 months. Cost: GHS 500–5,000 (application and registration fees)
Consequences of Non-Compliance
- EPA can issue stop-work or closure order immediately
- Fines up to GHS 50,000 per day of violation
- Criminal prosecution of directors
- Personal liability for environmental damage
- Remediation costs (you pay to clean up)
Renewal
EPA permits and registration certificates must be renewed annually. EPA conducts compliance inspections. Businesses that have changed operations significantly may need to apply for a new permit.
