Ghana has a unified Lands Commission system, but the practical reality of land registration — the types of land, the title structures, the fraud risks, and the processes — differs significantly between Accra and Kumasi. Here's what buyers need to know.
Land Tenure in Accra (Greater Accra Region)
Greater Accra is a mix of different land tenures:
- State/government land: Vested in the state and managed by the Lands Commission. Common in developed areas and government layout schemes.
- Stool land: Traditionally held by Ga, Dangme, and Krobo stools. Large portions of peri-urban Accra (Kasoa, Oyibi, Dodowa) are stool land.
- Family/private land: Privately owned land, including inherited land.
The Accra Lands Commission (Head Office in Cantonments) manages the Land Title Registry for Greater Accra. The Land Title Registration system is relatively well-established in Accra compared to other regions.
Land Tenure in Kumasi (Ashanti Region)
Kumasi is dominated by Ashanti stool land dynamics:
- Kumasi Traditional Area: Most land around Kumasi falls under the jurisdiction of the Asantehene's Lands Secretariat — Oyoko Royal Family lands and various divisional stools.
- The Asantehene and Kumasi Traditional Council: Play a more centralized and formalized role in land allocation than many other stool authorities. The Kumasi Traditional Area Lands Secretariat is a major land administration institution.
- Land Secretariat vs Lands Commission: The Kumasi Traditional Area Lands Secretariat handles allocation and initial documentation; the Lands Commission handles registration and title.
Key Practical Differences
Allocation Process
Accra: Many plots are from government layout schemes (Lands Commission direct allocation) or from various stool authorities. Multiple competing authorities create more fraud risk.
Kumasi: The Kumasi Traditional Area Lands Secretariat provides more centralized allocation documentation for stool land — this is both more organized and more verifiable than many Accra stool arrangements.
Document Types
Accra: You'll encounter Lands Commission leases, indentures, allocation letters from various stools, site plans from different surveyors.
Kumasi: Kumasi Traditional Area Lands Secretariat documents have their own format; always verify with the Secretariat directly.
Fraud Patterns
Accra: Higher incidence of fake allocation letters, multiple selling of same plots (especially in Kasoa, Oyibi, Spintex areas), impersonation of chiefs.
Kumasi: Land guards and encroachment are significant issues; disputes between sub-stools claiming jurisdiction over the same area; fraudulent Secretariat documents exist.
Search Process
Accra: Search at Lands Commission, Cantonments. Also search at the relevant stool's own records if stool land.
Kumasi: Search at Kumasi Lands Commission AND at the Kumasi Traditional Area Lands Secretariat (Manhyia). Both searches are recommended.
Land Title Registration
Land Title Registration is more developed in Accra (covering most of Greater Accra) than in Kumasi, where parts of the region still use the older Deeds Registry system. Check which system applies to the specific plot before assuming the registration status.
The Common Advice for Both Cities
Regardless of city:
- Never pay without a Lands Commission search
- Verify the seller's identity independently
- Use a local lawyer familiar with the specific area's tenure system
- Get a licensed surveyor to physically demarcate boundaries before payment
