You build a brand, invest in marketing, grow customer recognition — then someone else registers your name as a trademark and demands you stop using it. This is not hypothetical. It happens in Ghana. Trademark registration is the only way to secure exclusive rights to your brand name and logo.
What Can Be Registered as a Trademark?
In Ghana, you can register:
- Business/brand names
- Logos and graphic designs
- Slogans and taglines
- Product names
- Distinctive shapes or packaging (trade dress)
A trademark must be distinctive — it must distinguish your goods or services from those of others. Generic terms (e.g., "Cold Water" for bottled water) and descriptive terms cannot be registered.
Where to Register
Trademarks in Ghana are registered at the Trademarks Registry, which is under the Ghana Intellectual Property Commission (GIPC) — formerly the Copyright Office and Registrar General's Department handled this, but GIPC now manages IP registrations.
The Nice Classification System
Trademarks are registered for specific classes of goods and services under the international Nice Classification (45 classes). You must specify which class(es) you are registering in:
- Class 25: Clothing
- Class 35: Advertising and business services
- Class 43: Restaurants and food services
- Class 9: Electronics and software
- Class 36: Financial services
You can register in multiple classes — each class is a separate registration fee.
The Registration Process
- Trademark search: Search the GIPC trademark database to confirm your mark is not already registered. Cost: approximately GHS 100–300.
- Application: File a trademark application at GIPC with: the mark (name/logo), list of goods/services, class(es), applicant details.
- Examination: GIPC examines the application for conflicts and compliance.
- Publication: The mark is published in the Trademarks Journal for opposition (anyone who believes it conflicts with their existing mark can oppose).
- Opposition period: 30 days (or as published) for third parties to object.
- Registration: If no opposition (or opposition fails), the trademark is registered and a certificate issued.
Total timeline: 6–18 months. Total cost: GHS 1,500–5,000 per class (search, filing, and professional fees).
Duration and Renewal
A registered trademark in Ghana is valid for 10 years from the filing date. It can be renewed indefinitely for further 10-year periods. Keep track of renewal dates — an expired trademark can be registered by someone else.

Can You Use the ™ Symbol Without Registration?
Yes — the ™ symbol (unregistered trademark) signals that you are claiming the mark as yours, even before registration. However, it gives you no legal protection in Ghana. Only the ® symbol (registered trademark) gives you enforceable exclusive rights.
